Welcome to 8EyeTieDye ("we," "us," or "our"), a Kinchito Commerce brand. By accessing or using our website at 8eyetiedye.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. Users under 18 may browse and generate designs but may not make purchases. You must be at least 18 years old and have the legal capacity to enter into a binding agreement to place an order or complete a purchase through the Site.

2. AI-Generated Designs

All tie-dye designs on 8EyeTieDye are generated by artificial intelligence models. By using our design generation feature, you acknowledge and agree that:

  • Designs are created by AI and are labeled as such. No human artist creates the patterns.
  • Each design is generated once and is unique. We do not guarantee the ability to reproduce any specific design.
  • Generated designs expire after 24 hours. If you do not purchase a design within that window, it is permanently deleted and cannot be recovered.
  • You do not acquire copyright ownership of AI-generated designs. Designs are provided for personal use on purchased merchandise only.
  • We reserve the right to limit the number of free design generations per session or per day.

3. Products and Orders

All products sold on 8EyeTieDye are manufactured on demand through print-on-demand partners. By placing an order, you acknowledge and agree that:

  • Products are made to order and cannot be canceled once production has begun.
  • Colors may vary slightly between the on-screen preview and the printed product due to differences in screens and printing processes.
  • Production and shipping times are estimates and may vary. We are not responsible for delays caused by our fulfillment partners or shipping carriers.
  • We do not accept returns for buyer's remorse or change of mind. If you receive a defective or damaged product, contact us within 14 days of delivery for a replacement.

4. Payments and Pricing

All prices are listed in United States Dollars (USD). Payments are processed securely through Stripe. By making a purchase, you agree that:

  • You authorize us to charge the payment method you provide for the total amount of your order, including applicable taxes and shipping.
  • Refunds are not available once a product has entered production. If your order has not yet entered production, you may request a cancellation by contacting us promptly.
  • We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that have already been placed.

5. Intellectual Property

The 8EyeTieDye name, logo, branding, website design, and all original content on the Site are the property of Kinchito Commerce and are protected by applicable intellectual property laws. AI-generated designs are not subject to copyright ownership by any party. You may not reproduce, distribute, or commercially exploit designs obtained from the Site beyond their use on purchased merchandise.

6. Prohibited Conduct

You agree not to:

  • Use automated tools, bots, or scripts to generate designs or place orders.
  • Attempt to circumvent rate limits, session controls, or security measures.
  • Resell, redistribute, or sublicense designs or products for commercial purposes without our written consent.
  • Use the Site for any unlawful purpose or in violation of any applicable laws.

7. Limitation of Liability

To the maximum extent permitted by applicable law, 8EyeTieDye and Kinchito Commerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to lost profits, loss of data, or business interruption, regardless of the theory of liability.

Our total liability for any claim arising from your use of the Site or purchase of products shall not exceed the amount you paid for the specific product giving rise to the claim.

8. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
